1. Agreement to Terms

By downloading, installing, or using FORGE Command ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

FORGE Command is operated by FORGE Command ("we", "us", "our"). The App is a field intelligence and construction site management tool designed for construction professionals.

2. Eligibility

You must be at least 18 years old to use FORGE Command. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

3. Account Registration

To use the App, you must create an account by providing accurate and complete information, including your name, email address, and company or organisation name.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Purchase and Payment

FORGE Command is available as a one-time purchase for £39.99 (or local equivalent). This purchase grants you a perpetual, non-transferable licence to use the App on your personal devices.

Payments are processed through Apple App Store or Google Play Store. All purchases are subject to the respective store's terms and refund policies.

Your purchase includes:

  • Full access to all current features of the App
  • All future updates and improvements at no additional cost
  • No subscription fees, no recurring charges, and no feature paywalls

5. Licence and Usage Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal and professional construction site management purposes.

You may not:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer or attempt to extract the source code of the App
  • Use the App for any unlawful purpose
  • Transmit any malicious code, viruses, or harmful data through the App
  • Use the App in a manner that could interfere with, disrupt, or negatively affect other users
  • Share your account credentials with others or allow others to access the App through your account

6. User Content

You retain full ownership of all content you create, upload, or store within the App, including but not limited to site diary entries, photographs, audit records, snag lists, and email drafts ("User Content").

By using the App, you grant us a limited licence to store, process, and transmit your User Content solely for the purpose of providing and improving the App's services. We will never sell, share, or use your User Content for any purpose other than delivering the App's functionality to you.

You are solely responsible for the accuracy, legality, and appropriateness of your User Content.

7. Regulatory Content Disclaimer

The App includes a Regulations Library containing reference material relating to UK construction legislation, including but not limited to CDM 2015, the Health & Safety at Work Act 1974, and Building Regulations.

This content is provided for quick-reference and informational purposes only. It does not constitute legal advice. You should always consult the full statutory texts and seek professional legal advice where necessary. We make no warranty that the regulatory content is complete, current, or applicable to your specific circumstances.

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to the practices described in the Privacy Policy.

9. GPS and Location Services

The App may request access to your device's location services for GPS stamping of site records. This is an optional feature. You can use the App fully without enabling location services, but GPS-stamped records will not include location data.

Location data is used solely for the purpose of stamping your site records and for weather data retrieval. We do not track your location in the background.

10. Availability and Updates

We strive to keep the App available and functional at all times, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We may release updates to the App from time to time. These updates may include bug fixes, new features, or security improvements. While we encourage you to install updates promptly, you are not obligated to do so.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FORGE Command and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App.

Our total liability for any claim arising from or related to these Terms or the App shall not exceed the amount you paid for the App.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless FORGE Command and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App, your User Content, or your violation of these Terms.

13. Termination

You may stop using the App at any time. You may also delete your account through the App's settings or by contacting us at support@forgecommand.com.

We may suspend or terminate your access to the App if you violate these Terms. Upon termination, your licence to use the App ceases immediately.

You may export your User Content at any time before termination. After account deletion, your data will be permanently removed within 90 days, except where legal retention obligations apply.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.
